End-User License Agreement ("Agreement")

Please read this End-User License Agreement ("Agreement") carefully before using PavementSoft ("Application").

By activating the "I Agree" toggle prior to enrolling with PavementSoft you and your organization are agreeing to be bound by the terms and conditions of this Agreement.

If you do not agree to the terms of this Agreement, do not click on the "I Agree" button and do not use the Application.

Limited Use

PavementSoft’s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Additionally, the disclosure is meant to inform you that Pavementsoft is compliant with applicable policies and any users using PavementSoft are subject to this privacy policy, terms of service and Google API Services User Data Policy.

Privacy Policy

This Privacy Policy outlines how PavementSoft ("we," "our," or "us") collects, uses, maintains, and discloses information collected from users ("you" or "your") of our OAuth service and associated applications, websites, and services (collectively referred to as the "Service"). We take your privacy seriously and are committed to protecting your personal information in compliance with Google's OAuth requirements, as well as applicable privacy laws.

1. Information Collection

1.1. User-Provided Information: We may collect personal information that you provide directly to us when using our Service, such as your name, email address, and other necessary information required for OAuth authentication.

1.2. Automatically Collected Information: We may also collect certain information automatically when you use our Service, including your device information, IP address, browser type, and usage data, to improve the functionality and performance of our Service.

2. Use of Information

2.1. We may use the information collected from you for the following purposes:

- To provide and maintain the Service.

- To authenticate and authorize your access to third-party services through OAuth.

- To improve our Service and develop new features.

- To communicate with you, including responding to your inquiries and providing updates about the Service.

3. Data Sharing and Disclosure

3.1. We do not sell, trade, or rent your personal information to third parties without your consent, except as described in this Privacy Policy or as required by law.

3.2. We may share your information with third-party service providers who assist us in operating the Service, conducting our business, or servicing you, subject to confidentiality obligations.

3.3. We may also disclose your information in response to a subpoena, court order, or other legal process, or when we believe it is necessary to comply with applicable laws, regulations, or governmental requests.

4. Data Security

4.1. We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction.

4.2. However, please note that no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee the absolute security of your information.

5. Third-Party Links

5.1. Our Service may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the privacy practices or content of these third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.

6. Children's Privacy

6.1. Our Service is not directed to individuals under the age of 13, and we do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us, and we will take steps to delete such information from our systems.

7. Google Play App

7.1. If you are using our Service through a Google Play app, please note that Google may collect certain information as described in its Privacy Policy. We encourage you to review Google's Privacy Policy in addition to this Privacy Policy.

8. Changes to This Privacy Policy

8.1. We reserve the right to update or change this Privacy Policy at any time. Any changes will be effective immediately upon posting the revised Privacy Policy on this page. Your continued use of the Service after we post any modifications to the Privacy Policy will constitute your acknowledgment of the modifications and your consent to abide and be bound by the updated Privacy Policy.

By using our Service, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy.

License

Pavement and Concrete Software Solutions Inc. (“Company”) grants you a revocable, non-exclusive, non-transferable, limited license to use the Application solely for your organization’s purposes strictly in accordance with the terms of this Agreement.

Restrictions

You agree not to, and you will not permit others to:

a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.

Modifications to Application

The Company reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.

The Modifications to Application section is for apps that will be updated or regularly maintained.

Term and Termination

This Agreement shall remain in effect until terminated by you or The Company.

The Company may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

This Agreement will terminate immediately, without prior notice from The Company, in the event that you fail to comply with any provision of this Agreement.

You may also terminate this Agreement by canceling your account and removing all copies thereof from your mobile device or from your desktop.

Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your desktop.

Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Amendments to this Agreement

The Company reserves the right, at its sole discretion, to modify or replace this Agreement at any time.

Pavement Soft Refund Policy

Software charges are assessed on a per-user basis and are charged at the beginning of a use (1 month) period. If you are not fully satisfied with the software and service please contact us directly at support@pavementsoft.com to request a full refund, pro-rata refund of the remaining period of use, or previous use periods.

Pavement Soft Privacy Policy

This Privacy Policy (the “Policy” or “Privacy Policy”) of Pavement & Concrete Software Solutions, Inc. (“Pavement Soft”, “we”, “us”, or “our”) describes the types of information we gather from people visiting www.PavementSoft.com (the “Site”) or who use the tools, software or services located there or that we otherwise we provide, and how we use such information. We understand the importance of privacy and accordingly, it is our policy to treat all information received in a responsible manner. By accessing the Site, you agree to be bound by this Policy. If you do not agree to the terms of this Policy, please do not use the Site or our services. Each time you use the Site or services, the current version of the Privacy Policy will apply. Accordingly, when you use the Site or services, you should check the date of this Policy (which appears at the top) and review any changes since the last version.

Types Of Information We Collect

Pavement Soft may collect two types of information from users of our Site: “personal information” which is information that can be used to locate you, contact you, or determine your specific identity (such as name, e-mail address, mailing address, phone number, etc.), as well as information you provide about your company, business, service providers, bids, invoices, jobs and customers as you use our services; and “aggregate information” which is information about your activities on the Site or in connection with the services that cannot be used to identify, locate, or contact you (such as frequency of visits to the Site, data entered when using the Site, Site pages most frequently accessed, browser type, etc.).

Collecting Your Personal Information

Pavement Soft collects personal information that is voluntarily provided when a user on our Site signs up for our services, logs into his or her account or uses our tools, software or services. Pavement Soft also collects and stores information about our user’s use of the Site and our tools, software and services. (Among other reasons, we collect and store such information in order to improve the services we provide for our users.)

Collecting Your Aggregate Information

Aggregate information is collected as you visit our Site or interact with our services even if you do not enter any information. Generally, aggregate information is used in a collective manner, and no single person can be identified by that compiled information. Pavement Soft uses aggregate information to provide its services, as well as to determine the use of our Site and to monitor, audit and analyze information pertaining to our business metrics.

Sharing, Selling and Trading of Your Personal Information with Third Parties

Pavement Soft, on occasion, may share personal information with third-party service providers as we deem necessary for the third party to fulfill its duties, such as processing credit card payments or other functions necessary to our business. These third-party service providers are not authorized to retain, share, store or use your personal information for any purposes other than to provide the services for which they have been hired to provide. When you submit your personal information, you also agree that we may use your personal information to contact you by email, telephone, cell phone, direct mail, or text message about certain offers made available by us or third parties that we believe you might be interested in based on the information you have provided to us. We do not sell, trade or otherwise share your personal information with unrelated third parties for their own marketing purposes; however, we may market certain offers to you on behalf of third parties that we determine you might be interested in.

We use your personal and aggregate information to provide you with services, to improve your experience on the Site and with the services, and to communicate with you and others you authorize with respect to information you request or that is otherwise provided in connection with providing the services. We may also use this information to help us target specific services or offers to you, to help us develop and improve the Site and services, and to tailor our Site and services to your needs and interests.

Sharing, Selling and Trading Aggregate Information Collected Online with Third Parties

We may use aggregated information to improve the Site and services, to monitor traffic and general usage patterns, and for other general business purposes. We may disclose aggregate information to third parties for a variety of business reasons, including to potential investors so that they may better understand our user base, etc. Aggregate information will not include any personal information and we will not disclose any personal information except as stated elsewhere in this Policy.

Other Instances When We Share Your Information

In addition to the foregoing, Pavement Soft may elect to share or transfer your personal information to unrelated third parties: (i) to comply with a legal requirement, a judicial proceeding, court order, or legal process served on Pavement Soft, (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of Pavement Soft; (iv) when we believe it is necessary to protect the rights, property, or safety of Pavement Soft or other persons, or (v) as otherwise required or permitted by law.

Cookies

If you do not provide us any of your personal information, we are limited in the information we may collect from you. For example, we may be able to determine your IP address for the purposes of administering the Site and tracking Site usage. However, your IP address may vary each time you visit or it may remain the same depending on the type of Internet connection you are using or the location from which you access the Site. We may also collect information about the websites that directed you to the Site after you clicked on a text or banner link or an ad from another website, or the day and time you visited the Site and how long you spent on the Site. We aggregate such information to help us to compile reports as to trends and other behavior about users visiting or using our Site; however such information is anonymous and cannot be tied directly to you.

We may also use “cookies” and your personal information to enhance your experience on the Site and with the services and to provide you with personalized offers. A cookie is a small data file placed on your computer’s hard drive that contains information that allows us to track your activity on the Site. The cookie itself does not contain any personal information; however, if you provide us any personal information the cookie may act as an identifier to tie your personal information to your IP address or computer. You may choose to delete cookies from your computer’s hard drive at any time or to disable cookies on your computer. If you delete cookies that relate to the Site, we may not be able to identify you upon your return to the Site. Additionally, if you disable your computer’s cookies, you may not be able to access certain features of the Site or services that require that cookies be enabled. The Site’s cookies cannot be used to read data from your hard drive and cannot retrieve information from any other cookies created by other websites. Additionally, our cookies cannot be used as a virus, Trojan horse, worm, or any other malicious tool that could impair your use of your computer. Our cookies are used to help us better understand how you and other users use the Site so we can continue to provide a better, more personalized user experience on the Site. We also share website usage information about our Site with those interested in running targeted promotional campaigns on the Site. For this purpose, we and our advertisers track some of the pages that you visit on the Site through the use of pixel tags (also called clear gifs).

Security Pertaining to Your Information

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal information.

We restrict access to personal information to Pavement Soft employees, service providers and agents who need to know that information in order to operate, develop or improve our services, or otherwise assist us with our business. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. We use secure socket layer (“SSL”) technology to encrypt and protect the security of your personal information, including but not limited to your credit card number, when it is sent over the Internet. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

Integrity of Your Data

Pavement Soft processes personal information only for the purposes for which it was collected and in accordance with this Policy. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

Children and Privacy

Our Site is not directed to children and we will not request personally identifiable information from anyone who we know to be under the age of 18, unless we have obtained verifiable parental consent from a parent or legal guardian. If we become aware that a user under the age of 13 has registered with our Site, provided personal information, and Pavement Soft has not obtained prior verifiable consent from a parent or legal guardian, we will immediately remove the user’s personal information from our files.

Links to Other Websites

The Site may contain links to websites operated by other people or companies. Those websites may have their own privacy policy or no privacy policy at all. Pavement Soft does not have any responsibility for those websites, and we provide the links solely for the convenience of our visitors.

Business Transfers

In the event that Pavement Soft sells substantially all of its assets, or one of Pavement Soft’s business units is acquired, personal information of visitors to the Site and aggregate information will likely be one of the transferred assets.

Changes to this Policy

We may change this Privacy Policy at any time and without prior notice, by posting the revised version of this Policy on our Site. Your continued use of the Site and/or services indicates your consent to our collection of and use of your personal and aggregate information under the then-current Policy.
